Terms of Service

What Hoxigen does

Hoxigen generates marketing content for the apps and sites you register, schedules it, and publishes it to the channels you connect. Content is queued ahead of its scheduled time so you can review, edit, reschedule or reject it. Items you do not review are published at their scheduled time. That behaviour is the product, not a defect — if you need every item approved first, reject anything you have not read.

We may change, add or remove features. If we remove something you materially rely on, we will tell account owners by email beforehand.

Eligibility and security

• You must be at least 18 and able to enter a contract.
• Give accurate details and keep them current.
• You are responsible for what happens under your account and for keeping your password safe. Tell us promptly if you suspect unauthorised access.
• Seats are for named people on your plan. Do not share one login between several people.

What you pay for

• Trial. New accounts get 14 days and 2,000 credits. The trial ends without a charge unless you choose and pay for a plan.
• Subscription. Plans renew automatically until cancelled. Prices are stated and charged in USD by our payment provider; your card issuer may add its own fee for a charge in a foreign currency.
• Credits. Every AI action costs credits at the published tariff shown on the pricing page and in the dashboard. Your monthly allowance resets each billing period and does not roll over.
• Running out. When credits run out, generation pauses until the period resets or you buy a top-up, unless you turned on pay-as-you-go. Already-generated items still publish.
• Top-ups. Extra credit packs are charged immediately. Credits you buy do not expire at renewal: each purchase stays on your account for 3 months from the day you buy it, then any unused credits from it expire. Bought credits are spent only after your plan's allowance for the period, oldest purchase first, and can be used while your subscription or trial is active.
• Pay-as-you-go. Where pay-as-you-go is offered on your account and you turn it on, generation continues after your plan's credits and your bought credits are used up, and each extra credit costs $0.013. We charge your saved card for them in steps as they are used (from $50 to $400, depending on your limit and payment history), and charge any remainder of $1 or more when the billing period ends; you can also settle the balance at any time. You set a monthly limit, up to the level your payment history allows; generation pauses when it is reached. Pay-as-you-go needs a saved card that does not expire before the billing period ends. If a charge is declined, generation pauses until the amount is paid. You can turn it off, or cancel your subscription, once the balance is settled; credits already used are always charged.
• Coupons. A coupon applies the discount it states for the number of months it states, then billing returns to the standard price. Coupons are not transferable or redeemable for cash, and we may withdraw an unredeemed one.
• Taxes. Hoxigen currently operates as an exempt dealer (עוסק פטור) under Israeli law, so no VAT is added where required.

Cancelling and refunds

Cancel from the dashboard at any time. Cancellation takes effect at the end of the paid monthly period or yearly term; you keep access until then, and we do not pro-rate unused time. Beyond the rights the law gives you as a consumer, fees paid are non-refundable.

If a payment fails we may retry it and suspend the account until it clears.

Ownership and the licence you give us

Everything you put in — your app details, brand material, knowledge base, edits and instructions — remains yours. Content generated for your apps is likewise yours, to the extent such output can be owned; note that AI output may not be protectable by copyright everywhere, and we cannot promise it is unique.

You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, adapt and publish that content solely to operate the service for you — including sending it to the AI and platform providers listed on our sub-processors page. This licence ends when the content is deleted from Hoxigen or your account is closed, except for copies retained under the Privacy Policy and copies already published to third-party platforms.

You confirm you have the rights to everything you supply, and that our using it as described does not infringe anyone else’s rights.

Personal data in your content

For personal data in the content you connect and create — your leads, the people who comment on your posts, anyone in your knowledge base — you are the controller and we process it on your behalf. The Data Processing Addendum governs that processing and is part of these terms; accepting these terms accepts it, and nothing needs signing. You confirm you have a lawful basis for the personal data you put into Hoxigen, including consent from the leads you email.

What we do not promise

Generated text, images, video and audio are produced by machine-learning models. They can be factually wrong, out of date, biased, off-brand, or similar to material that already exists. We do not warrant that output is accurate, original, non-infringing or fit for any particular purpose.

You are responsible for what publishes under your name. Review anything where accuracy, legal compliance or brand safety matters — regulated claims, prices, medical or financial statements, comparative advertising, and anything about identifiable people. The review queue and Telegram approvals exist for exactly this.

Their rules apply too

Publishing to Facebook, Instagram, X, LinkedIn, TikTok, Reddit, YouTube, Telegram, WordPress, Shopify, Wix, Webflow, Ghost, Framer, Notion or any other platform is subject to that platform’s own terms and policies, and you remain responsible for following them. We are not responsible for a platform changing its rules or API, rate-limiting, rejecting, removing or suspending your content or account.

Our service utilizes YouTube API Services. By using our service and connecting your YouTube channel, you are agreeing to be bound by the YouTube Terms of Service and the Google Privacy Policy.

Tokens can expire or be revoked by the platform. When that happens, publishing to that channel stops and we tell you in the dashboard.

What you must not do

• Publish content that is illegal, defamatory, hateful, harassing, sexually explicit, or that infringes someone’s intellectual property or privacy.
• Impersonate a person or organisation, or generate deceptive endorsements, fake reviews or fabricated testimonials.
• Spam, run engagement schemes, or evade a platform’s rate limits or automation rules.
• Market anything you are not permitted to market, or make claims a regulator would require you to substantiate and you cannot.
• Reverse engineer the service, resell access outside your plan’s seats and apps, attempt to extract our prompts or models, or probe our security without written permission.
• Overload the service, or use it to generate content for someone else’s brand without their authorisation.

We may remove content or suspend an account that breaches this section, and we will tell you why where we can.

Uptime and support

We aim to keep Hoxigen available and to publish scheduled items on time, but we do not offer a contractual uptime guarantee. Maintenance, provider outages and platform failures can delay a publish; failed publishes are retried and then reported in your log.

Support is by email during Sun–Thu, 09:00–18:00 Israel time, with a target first response of one business day.

Ending the agreement

A workspace owner may close the workspace at any time by deleting it under Your data in Workspace settings, after taking a full export there if they want one; anyone may also ask by emailing the privacy address in our Privacy Policy. A deleted workspace is permanently deleted after a 30-day grace period. We may suspend or terminate an account for a material breach of these terms, non-payment, or activity that puts the service or other customers at risk — immediately where the breach is serious or unlawful, otherwise after notice and a reasonable chance to fix it.

On termination, the licence in section 4 ends and your data is handled as set out in the Privacy Policy. Sections that by their nature should survive — ownership, disclaimers, liability, indemnity and governing law — survive.

The legal limits

Except as these terms expressly state, the service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that it will produce any particular marketing, traffic or commercial result.

To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, goodwill or data. Our total liability arising out of or relating to the service is capped at the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot lawfully be excluded.

You will indemnify us against third-party claims arising from your content, your use of the service in breach of these terms, or your breach of a platform’s rules.

Updating these terms

We may update these terms. For material changes we will notify account owners by email at least 30 days before they take effect. If you do not accept a change, cancel before it applies; continuing to use Hoxigen after that means you accept it.

The rest

These terms, the Data Processing Addendum and the Privacy Policy are the entire agreement between us on this subject. You may not assign them without our consent; we may assign them to a successor of our business. If a provision is unenforceable, the rest stays in force. Not enforcing a right once does not waive it.

These terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv, Israel have exclusive jurisdiction — without affecting any right you have as a consumer to bring proceedings where you live.
